On November 11, 2012, the Harris County Sheriff’s Department arrested 31-year-old Eric Von Krueger after confiscating pills from him that they believed were Alprazolam, an anti-anxiety medication.
On January 10, 2013, Von Krueger pled guilty in Harris County Criminal District Court to a misdemeanor charge of possession of a controlled substance. He was sentenced to four days in the Harris County Jail.
In May 2013, laboratory tests performed by the Harris County Institute of Forensic Sciences were negative for the presence of any controlled substance.
In May 2016, Von Krueger’s defense attorney filed a state petition for a writ of habeas corpus seeking to vacate the conviction. With the support of the prosecution, the conviction was vacated and the prosecution dismissed the charge.
