On April 2, 2016, police in Houston, Texas arrested 43-year-old David Barrientos after they confiscated from him pills which theys suspected were hydrocodone, a codeine-based painkiller.
On April 6, 2016, Barrientos pled guilty in Harris County Criminal District Court to a misdemeanor charge of possession of a controlled substance. He was sentenced to 45 days in the Harris County Jail.
On April 13, 2016, the Harris County District Attorney’s conviction integrity unit informed Barrientos’ attorney that crime laboratory tests were negative for any controlled substance.
The prosecution joined with Barrientos’ attorney in a motion to vacate the conviction. On May 5, 2016, the conviction was vacated and the prosecution dismissed the charge.
