On June 3, 2015, police in Spring, Texas arrested 17-year-old J’Avarus Winston after confiscating pills that they believed were Alprazolam, an anti-anxiety medication.
On October 19, 2015, Winston pled guilty in Harris County Criminal District Court to a misdemeanor charge of possession of a controlled substance. He was sentenced to 18 months of community supervision.
On February 2, 2016, laboratory tests were performed at the Harris County Institute of Forensic Sciences and no controlled substances were detected.
The report was sent to the Harris County District Attorney’s conviction integrity unit, which forwarded it to Winston’s defense attorney, who filed a motion to vacate the conviction.
On April 7, 2016, the motion was granted and the prosecution dismissed the charge.
