On August 11, 2012, police in Montgomery County, Texas arrested 30-year-old Alan Tong after confiscating what the officers believed were individual hits of LSD.

On August 15, 2012, Tong pled guilty in Montgomery County Criminal District Court to possession of a controlled substance. He was sentenced to six months in Texas State Jail.

In 2015, the Montgomery County District Attorney’s Office was informed that the Texas Department of Public Safety crime lab had tested the substances seized from Tong and the tests were negative for any controlled substance.

The prosecution informed Tong’s attorney and in July 2015, joined in a state petition for a writ of habeas corpus seeking to vacate Tong’s conviction. The Texas Court of Criminal Appeals granted the writ in October 2015 and ordered Tong’s conviction vacated.

On December 4, 2015, the prosecution dismissed the charge.
