On December 5, 2014, police in Houston, Texas arrested 32-year-old Marvin McGee after they confiscated a white chunky substance from him that field-tested positive for cocaine.
On December 9, 2014, McGee pled guilty in Harris County Criminal District Court to possession of a controlled substance. He was sentenced to 30 days in the Harris County Jail.
On January 6, 2015, after McGee had been released, the Houston Police crime laboratory tested the material seized from him and no controlled substance was found.
The laboratory informed the Harris County Conviction Review Unit which notified McGee’s defense attorney. The prosecution joined in a motion to vacate the conviction.
On January 8, 2015, the conviction was vacated and the prosecution dismissed the charge.
