On September 6, 2014, Houston County Sheriff’s police arrested 20-year-old Cecilia Guevara after they seized a baby bottle from her that was filled with a red liquid that they believed contained codeine.
On September 8, 2014, Guevara pled guilty in Harris County Criminal District Court to possession of a control substance. She was sentenced to two years of community supervision.
On December 24, 2014, the Harris County Institute of Forensic Sciences tested the liquid and no controlled substance was found. The lab informed the Harris County District Attorney’s Conviction Integrity Unit, which informed Guevara’s defense lawyer.
On January 15, 2015, the prosecution and defense presented a state-court petition for a writ of habeas corpus to vacate the conviction. The conviction was vacated and the prosecution dismissed the charge.
