On May 4, 2014, police in Houston, Texas arrested 24-year-old Rogelio Vasquez and confiscated what they believed were Xanax pills for which Vasquez did not have a prescription.
On May 6, 2014, Vasquez pled guilty in Harris County Criminal District Court to possession of a controlled substance. He was sentenced to 10 days in Harris County Jail.
In June 2014, the Harris County District Attorney’s Post Conviction Review Unit was informed that the Houston Police crime laboratory tests on the pills identified them as a non-prescription sedative.
The prosecution informed Vasquez’s defense attorney and joined in a motion to vacate the conviction. On June 5, 2014, the conviction was vacated and the charge was dismissed.
