On May 9, 2014, police in Houston, Texas arrested 40-year-old Derick Pitre after they seized white powder from him that field-tested positive for the presence of cocaine.
Five days later, on May 12, 2014, Pitre pled guilty in Harris County Criminal District Court to possession of a controlled substance. He was sentenced to six months in Texas State Jail.
On May 30, 2014, the Houston Police crime laboratory tested the powder seized from Pitre and no controlled substances were found. The lab notified the Harris County District Attorney’s Post Conviction Review Unit which informed Pitre’s defense attorney.
On June 9, 2014, the prosecution joined in a motion with the defense attorney to vacate the conviction. The motion was granted, the charge was dismissed and Pitre was released.
