On May 21, 2014, police in Houston, Texas arrested 27-year-old Stacey Berghoff after they found her in possession of what they believed was Xanax, a controlled substance, without a prescription.
On May 28, 2014, Berghoff pled guilty in Harris County Criminal District Court to possession of a controlled substance and was sentenced to 15 days in jail.
The Houston Police Department crime lab later tested the pills seized from Berghoff and discovered that the pills were negative for a controlled substance. The lab notified the Harris County District Attorney’s Post Conviction Review Unit, which then informed Berghoff’s attorney and joined in a motion to vacate the conviction.
On June 14, 2014, the motion was granted and the prosecution dismissed the charge.
