On April 14, 2014, police in Houston, Texas arrested 29-year-old Kacie Lunsford after they seized a white powder from her that field-tested positive for cocaine.
On April 21, 2014, Lunsford pled guilty in Harris County Criminal District Court to possession of a controlled substance. She was sentenced to court-supervised probation for two years.
The Houston Police Department crime laboratory tested the powder seized from Lunsford on May 21, 2014. The tests found no controlled substances present.
The lab notified the Harris County District Attorney’s Post Conviction Review Unit, which then informed Lunsford’s attorney of the negative test result. On September 25, 2014, the prosecution joined the defense in presenting a motion to vacate the guilty plea on the basis of actual innocence. A judge granted the motion and the charge was dismissed.
