This seminar will examine the legal aftermath of September 11, with special emphasis on the powers of the different branches of government in wartime. Topics to be covered include: military commissions, the detention of enemy combatants, the suspension of habeas corpus, torture, domestic espionage, and the legal framework for responding to emergencies.
