On December 3, 2015, police in Katy, Texas arrested 21-year-old Carlos Hernandez after they confiscated suspected Alprazolam, an anti-anxiety drug, from him.
On December 28, 2015, Hernandez pled guilty in Harris County Criminal District Court to a misdemeanor charge of possession of a controlled substance. He was sentenced to 52 days in the Harris County Jail.
In 2016, the Harris County District Attorney’s conviction integrity unit was notified that laboratory tests were negative for the presence of any controlled substance.
Hernandez’s attorney was informed of the lab test results and filed a motion to vacate Hernandez’s conviction. On March 4, 2016, the conviction was vacated and the prosecution dismissed the charge.
