On July 15, 2015, police in Houston, Texas arrested 27-year-old Jose Yac-Garcia after confiscating a plastic bag containing white powder that field-tested positive for cocaine.

On July 20, 2015, Yac-Garcia pled guilty in Harris County Criminal District Court to a charge of possession of a controlled substance. He was sentenced to probation for two years.

In August 2015, the Houston Police crime laboratory tested the powder and determined no controlled substance was present. The laboratory notified the Harris County District Attorney’s Conviction Integrity Unit, which informed Yac-Garcia’s attorney.

The prosecution joined the defense in a motion to vacate the conviction. On September 10, 2015, the motion was granted and the prosecution dismissed the charge.
