SUMMARY:In 2011, defense counsel submitted a motion to vacate three of defendant's prior convictions for Loitering for the Purpose of Engaging in Prostitution [PL §240.37]. The Court granted the motion. At the time of these convictions, she was only 17 years old and working for a pimp. The pimp told the police that the victim was was 18 and 19 on her second and third arrests. Defendant was forced to engage in commercial sex acts in New York, Washington, DC, Virginia and Florida. When defendant told her pimp that she wanted to return to her family in New York, he forced defendant to have his nickname tattooed on her forearm so that even if she left, everyone would know she belonged to him.
