Consumer Class Actions

The Future of Class Actions and Their Role in Consumer Advocacy

Consumer advocacy is at a critical turning point. Class actions are a vital component of the private enforcement of consumer rights. However, the procedure currently is under legislative and judicial attack that threatens its continuing viability. This course will study the history of class action developments and the changing role they have played in the overall strategy to protect consumer interests. The focus will be on recent significant challenges to the procedure from public policy and legal ethics perspectives. The class will combine traditional lecture and discussion with a practical skills opportunity through in-class argument presentations leading to a maximum fifteen (15) page written requirement.
